{"id":4709,"date":"2024-11-11T13:37:58","date_gmt":"2024-11-11T12:37:58","guid":{"rendered":"https:\/\/ctakomunikacije.hr\/?p=4709"},"modified":"2024-11-19T15:51:20","modified_gmt":"2024-11-19T14:51:20","slug":"influencers-and-advertising-croatias-gray-area","status":"publish","type":"post","link":"https:\/\/ctakomunikacije.hr\/en\/influencers-and-advertising-croatias-gray-area\/","title":{"rendered":"Influencers and Advertising \u2013 Croatia&#8217;s Gray Area"},"content":{"rendered":"\n<p>You\u2019ve probably heard about Ecija Ivu\u0161i\u0107 Belo\u0161evi\u0107 and the <a href=\"https:\/\/www.netokracija.com\/ecija-ivusic-kazna-influencer-marketing-228363\" target=\"_blank\" rel=\"noreferrer noopener nofollow\">latest case of penalizing influencer advertising<\/a> on social media. The influencer has been found guilty (not yet final) and ordered to pay a fine of 665 euros plus 100 euros in court costs due to the (prohibited) promotion of electronic cigarettes on her Instagram profile. While she isn\u2019t the only one penalized in this way, both in Croatia and globally, there\u2019s still a strong sense that the influencer advertising space remains a \u201cWild West\u201d with ineffective regulations.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Why was she fined?<\/h3>\n\n\n\n<p>Ecija was among a group of influencers taken to Egypt by the tobacco product company WIIP. They posted photos from the trip with the hashtag #wiiptrip. It\u2019s assumed that someone reported her to the State Inspectorate because, although no tobacco products were shown in the photos, the context was easy to understand.<\/p>\n\n\n\n<p>She wasn\u2019t fined for <strong>unauthorized or covert advertising <\/strong>on <a href=\"https:\/\/ctakomunikacije.hr\/en\/how-to-navigate-the-era-of-microtrends-on-social-media\/\">social media<\/a> because her posts weren\u2019t marked as sponsored content, but rather for <strong>indirectly advertising tobacco products<\/strong>, which is prohibited by the <a href=\"https:\/\/www.zakon.hr\/z\/909\/Zakon-o-ograni%C4%8Davanju-uporabe-duhanskih-i-srodnih-proizvoda\" target=\"_blank\" rel=\"noreferrer noopener nofollow\">Law on the Restriction of Tobacco and Related Products<\/a>. However, some still claim that their profiles are private, only sharing moments from their daily lives.<\/p>\n\n\n\n<p>It\u2019s clear as day that influencers, among other things, are funded by promoting products and services on their profiles. Influencers often covertly promote brands, making it difficult to discern if the content is promotional. For instance, at a recent digital marketing panel, one influencer openly admitted that she doesn\u2019t label posts as sponsored because it reduces her audience reach and she needs to present good analytics to her client.<\/p>\n\n\n\n<p>Some influencers, however, aim to maintain a good reputation and relationship with their audience, who believe that all those products and services are genuinely used and positively experienced by the influencer. Influencers know that if they emphasize their positive review as part of a paid sponsorship, it shifts the perspective and influences the decision to purchase a product.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Why (doesn\u2019t) regulation exist? <\/h3>\n\n\n\n<p>In Croatia, there is legislation for media, electronic media, and advertising; however, there isn\u2019t specific regulation clearly covering influencers on social media. In other words, any communication (regardless of the media) that a consumer cannot immediately recognize as paid rather than editorial media content is prohibited by law.<\/p>\n\n\n\n<figure class=\"wp-block-image size-full\"><img decoding=\"async\" width=\"760\" height=\"157\" src=\"https:\/\/ctakomunikacije.hr\/wp-content\/uploads\/2024\/11\/Zakon-o-medijima-cl.-20-st.-1-.-1-1.jpg\" alt=\"\" class=\"wp-image-4710\"\/><figcaption class=\"wp-element-caption\">The Electronic Media Act, Article , Paragraph 4 (Zakon o medijima, \u010dl. 4. st. 1.)<\/figcaption><\/figure>\n\n\n\n<p>Of course, we know that covert advertising can be seen in various TV shows when a product suddenly \u201cappears\u201d on screen, but not to this extent and without regulatory oversight. However, ethical codes and laws exist; they\u2019re just intentionally ignored, seeking a \u201cgray\u201d advertising zone. For example, instead of labeling a post as paid, influencers might add a hashtag or brand tag and pretend that this alone informs the audience that it is a sponsorship.<\/p>\n\n\n\n<p>We won\u2019t delve into issues with questionable brands and products presented to the audience, nor their moral responsibility and role toward society.
